These Terms explain how you can use Publysh. You’re responsible for your account and content, and you keep ownership of what you create. We provide the platform as-is, may update it over time, and may suspend accounts that misuse it. If you subscribe to a paid plan, fees apply. These Terms are governed by Victorian law.
1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the Publysh website and platform (the “Service”), operated by Publysh Pty Ltd (“Publysh”, “we”, “us”, “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 18 years of age to use the Service.
If you are using the Service on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms.
3. Description of the Service
Publysh provides a digital platform designed to help authors and creators plan, organise, and manage publishing projects through tools such as strategies, workflows, tasks, and related features.
We may modify, update, or discontinue parts of the Service at any time.
4. Accounts
To use certain features, you must create an account.
You agree to:
- Provide accurate and complete information
- Keep your login credentials secure
- Notify us promptly of any unauthorised access
You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. User Content
You retain ownership of any content you create or upload to the Service (“User Content”).
By using the Service, you grant Publysh a non-exclusive, worldwide, royalty-free licence to host, store, process, and display your User Content solely for the purpose of operating and improving the Service.
You are responsible for ensuring that your User Content does not:
- Infringe intellectual property rights
- Violate any applicable law
- Contain unlawful, harmful, or offensive material
We may remove content that breaches these Terms.
6. Intellectual Property
All intellectual property rights in the Service, including software, branding, design, and content created by Publysh, remain the property of Publysh or its licensors.
You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
7. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes
- Interfere with the operation or security of the platform
- Attempt to gain unauthorised access to other accounts or systems
- Reverse engineer or attempt to extract source code
8. Fees and Payments (If Applicable)
Some features of the Service may require payment.
If you subscribe to a paid plan:
- You agree to pay all applicable fees
- Payments may be processed through third-party payment providers
- Subscription fees may renew automatically unless cancelled
We may change pricing with reasonable notice.
9. Termination
You may stop using the Service at any time.
We may suspend or terminate your access if you breach these Terms or if required to comply with legal obligations.
Upon termination, your right to access the Service will cease.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
To the extent permitted by law, Publysh makes no warranties regarding:
- The accuracy or reliability of the Service
- Continuous, uninterrupted, or error-free operation
- Fitness for a particular purpose
Nothing in these Terms excludes guarantees that cannot be excluded under Australian Consumer Law.
11. Limitation of Liability
To the maximum extent permitted by law, Publysh is not liable for:
- Indirect or consequential loss
- Loss of profits, revenue, or data
- Business interruption
Where liability cannot be excluded under Australian Consumer Law, our liability is limited to resupplying the Service or refunding the relevant amount paid.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle personal information.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be published on our website with a revised “Last updated” date.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia.
Any disputes arising in connection with the Service will be subject to the exclusive jurisdiction of the courts of Victoria.
